Terms of Service

These Terms of Service ("Terms") govern your access to and use of ScopeCommandHQ (the "Service"), operated by the current ScopeCommandHQ operator ("we," "us," or "our"). By using the Service or purchasing any credits, you agree to be bound by these Terms.

1. Nature of the Service

ScopeCommandHQ produces AI-drafted estimates and insurance claim supplements intended to assist licensed contractors, sales representatives, and business owners. All outputs are drafts. They are not licensed estimates, not guaranteed-accurate, and not a replacement for a qualified estimator, licensed contractor, or insurance adjuster.

2. Your Responsibility

You — the contractor, sales representative, or business owner purchasing and using the output — are solely responsible for:

  • Verifying every quantity, unit price, line item, and total before presenting to a homeowner, adjuster, or carrier.
  • Confirming that every code citation applies to the specific property's jurisdiction and year of construction.
  • Confirming that every manufacturer specification applies to the actual materials being installed.
  • Obtaining all required building permits, licenses, and inspections.
  • Executing the actual repair work to code and manufacturer standards.
  • Complying with all applicable state licensing, consumer-protection, and insurance laws in your jurisdiction.

3. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CODE COMPLIANCE, CARRIER APPROVAL, PRICING ACCURACY, AND WARRANTY ELIGIBILITY. AI OUTPUTS ARE NOT GUARANTEED TO BE ACCURATE OR COMPLETE.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS (US$100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, CARRIER DENIALS, BUSINESS INTERRUPTION, OR LOSS OF DATA.

5. Indemnification

You agree to indemnify, defend, and hold harmless ScopeCommandHQ, its operators, affiliates, and employees from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any applicable law, or (d) documents you generate, edit, or distribute using the Service, including any homeowner, adjuster, or carrier dispute.

6. Purchases, Credits, and Refunds

  • Pay-per-use: Purchases unlock a single AI draft for one property/claim. You receive unlimited edits and re-exports for that draft.
  • Bundles: Multi-credit packs apply discounts to a specific tier. Credits do not expire but are non-transferable to other tiers without operator consent.
  • Free trial: New accounts receive 1 free estimate credit on signup. No payment method required.
  • Non-refundable once generated: Because the AI work has been performed, a draft's cost is non-refundable once the draft is generated. Unused credits are refundable within 14 days of purchase.
  • Payment processing: Stripe. Taxes where applicable.

7. Acceptable Use

You may not:

  • Misrepresent AI drafts as licensed or warranted estimates.
  • Use the Service to commit insurance fraud or inflate claims beyond honest field observation.
  • Reverse-engineer, scrape, or attempt to extract the Service's models or prompts.
  • Reuse documents on unrelated properties without regenerating.
  • Infringe third-party intellectual property (logos, trademarks, etc.) in generated templates.

8. Your Content

You retain ownership of documents, templates, photos, and claim data you upload. You grant us a limited license to process that content solely to operate and improve the Service. We do not sell your content.

9. AI Output

AI outputs are generated by third-party large-language models. We make no guarantee that outputs are factually accurate, legally compliant, or carrier-approved. You are the reviewer of record.

10. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may stop using the Service at any time. Unused credit refund eligibility is preserved per Section 6.

11. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Exclusive venue for disputes is the state or federal courts located in Franklin County, Ohio.

12. Changes

We may update these Terms. Material changes will be posted on this page with a new "Last updated" date. Continued use after changes constitutes acceptance.
